Our rules and terms of attendance

ACCOMMODATION

Each guest is bound by the itinerary and rules of the specific retreat they have booked. Specific destinations can be chosen for a retreat. However, provided the conditions of luxury and accommodation are not met as advertised for a guest's specific retreat, Positivium reserves the right in its absolute discretion to change  accommodation for a retreat. Positivium will inform each guest before such a change, of the location of the new villa/hotel and the reasons for the change by email and any other agreed mode of communication.

 

YOUR RETREAT ATTENDANCE

By purchasing all or part of your ticket you agree to attend your chosen retreat and agree that your package is non-refundable unless your retreat is cancelled by Positivium. On completing and submitting your booking form during the ticket purchase process via our website, you agree to be bound by our retreat rules.

COVID- 19

We appreciate booking a retreat during the current climate is not an easy task, that's why we have reviewed our cancellation policy to give you complete peace of mind. 
If you are unable to travel due to COVID-19 restrictions – borders are closed in the country where you are traveling from, or country you are traveling to, 100% of your funds will be used towards the next Positivium retreat.

Please note, if you are required to quarantine in your country of residence upon your return your booking won’t be refundable.

 

RETREAT DATABASE

For at least the duration of the moment of purchase until the end of your chosen retreat, it is important for us to have your current details including mobile phone number and email address in our database. By purchasing all or part of your ticket, you agree that we can hold your personal details for us to use in connection with your retreat. If your contact details change, please let us know

 

PAYMENTS

We do not accept partial payments and only full payments.

By providing us with your payment details, you accept and consent to these terms. Failure to pay the balance(s) due may result in the guest not being admitted to the retreat.

 

RETREAT ITINERARIES

A sample retreat itinerary will be provided to you for each retreat. Itinerary content is for guidance and may change depending on circumstances such as unavoidable change of trainer, weather changes and other situations beyond our control. Where there are changes or cancellations, we will always endeavour to provide suitable, similar replacement activities for the changed activities. We will not provide partial or any other refunds for replaced activities.

YOUR PERSONAL INFORMATION

We will use the personal information you provide to us in connection with your retreat attendance in accordance with our Privacy Policy.

 

CHILDREN

The retreats are typically designed for adults, but aim to be child-friendly. In cases where we have family/child friendly retreats, please read the retreat guidance and terms carefully about its rules regarding children, since they will vary. Please remember that your children are your responsibility at all times when present at the accommodation and ensure they are not left unattended at any time.

 

PRIVACY FOR GUESTS

Guests must not approach, disturb or solicit others in their accommodation with whom they are not personally acquainted unless it is mutually agreeable. Doing so may lead to caution or eviction.

 

CONFIDENTIALITY

Positivium management and all staff members are required to adhere to the strictest confidentiality standards and pledge to maintain all records and personal information concerning the guests in the strictest confidence.

 

ILLEGAL DRUGS/SUBSTANCES/ITEMS

No guest shall purchase, use, ingest, possess, sell or otherwise distribute illegal drugs or other substances or attempt to do any of the same from any guest or shall ask any Positivium staff for illegal drugs or other substances while on our retreats premises or on any activities listed on our itinerary or in the immediate vicinity thereof. If any of the actions above prove true, the relevant guest will be removed from the retreat immediately.

 

No guest shall purchase, sell, use or possess any object which is illegal or offensive while on retreats premises or on any activities listed on our itinerary or in the immediate vicinity thereof. If any such objects are found, the item will be confiscated, the relevant guest will be removed from the accommodation or activity in question and their attendance may be terminated immediately and depending on the circumstances we may have to call the police or relevant authorities.

 

BILLS

All bills must be settled in full before leaving the retreats optional activities. There are no credit facilities. Guests are responsible for their bills.

 

 

 

 

ACCOMODATION EVENTS

We love to hear what our guests get up to at Positivium Retreats. Whilst you are a guest at our retreats, we may ask you to give your views of, and experiences at, Positivium Retreats and we may also film, video or photograph our events and itinerary activities for use in our advertising, promotions, public relations, and other commercial/business purposes. If you take part in these interviews or events, you agree that we may use your name, image and limited other information and consent to us publishing any materials produced by, or for us, for any purpose without your further consent.

 

ACCIDENTS AND INJURIES

We want all our guests to relax and enjoy the activities and facilities available at our retreats in safety. Please be aware that some of our venues are set in open country with lakes, cliffs and other natural features that can be hazardous.


Guests agree to observe the rules, safety explanations and any signs published or displayed on our retreats at any time, only swim in designated areas and to take reasonable precautions when travelling around the grounds or using the facilities.

If a guest has an accident or suffers any injury at, or in the vicinity of, the venue or during our retreat activities, we do not take any responsibility as each guest is responsible of their own well-being on site. Thus, please report to a member of staff immediately. As well as wanting to check on a guest’s well-being, this information is needed in order to help us comply with our health and safety obligations and for insurance purposes.

 

 

DISCIPLINARY PROCEDURE

Conduct by a guest that is prejudicial to the reputation and character of Positivium may result in expulsion of such a guest with immediate effect. Such conduct may include inappropriate, violent or abusive behaviour or the communication of information concerning other guests on the retreat to the media. An expelled guest may not return to any retreat as a guest or friend of a guest. Positivium will not refund such a  guest's retreat costs and ensuring flights for such a guest will be purely at Positivium’s discretion. Any guests who wilfully remove, damage or destroy any property belonging to the accommodation or to other guests on the premises of the venue(s) or on retreat activities will be liable to expulsion. Positivium will not be liable for replacing the damaged items and such a guest may be sued for repairs and/or compensation.

 

Every guest binds him/herself to abide by the rules and regulations of Positivium at all times upon purchasing a retreats package.

 

CONSTITUTION

Positivium is constituted to encourage non-political, social and recreational activities.

 

USE OF EQUIPMENT AND FACILITIES

Use of any of the gym or fitness equipment, areas or facilities available at the accommodation is entirely at the risk of a guest or his or her guests. Introduction sessions explaining how to safely and properly use any provided or available fitness equipment are available and in the case of supervised training, all safety precautions should be explained clearly by the instructor. You must not use any equipment or undertake any activity unless you are satisfied that you are competent to do so in a safe and proper manner.


When using any equipment and facilities available at accommodation, you must take care to safeguard your own health and safety and that of other people, and you will be solely responsible for any loss or injury that you cause to yourself, other persons or to the equipment or facilities to the extent that it is caused through your unsafe or improper use of the equipment or facilities (including your use of them whilst under the influence of alcohol or medication) or your failure to advise staff of a medical condition relevant to your use of the equipment or facilities.

 

 

 

LIABILITY OF Positivium Retreats

All items brought into accommodation are brought and left entirely at the risk of a guest. Positivium, its servants and/or agents shall not be liable to any member or guest for any loss, damage or injury suffered by them or their property howsoever caused. This is not intended to affect any mandatory rights a guest may have under local law that we cannot legally restrict or exclude.

 

INTERPRETATION OF THE RULES

In the event of any dispute arising as to the meaning or interpretation of these rules, the matter shall be referred to the Positivium host on site. If this needs escalation, it will be referred to the Positivium Retreats complaints team, whose decision with respect to the dispute shall be final and without appeal.


These rules shall be governed and construed in accordance with English law and each member agrees to submit to the exclusive jurisdiction of the courts of England.

 

AMENDMENTS TO THE RULES

Positivium may change these rules from time to time, by displaying notification of the change. Thus, please be aware that the latest version of our rules are displayed on our website. It is your responsibility to keep up to date with the rules.
